Disposition of inheritance

An heir may not always want or be able to maintain inherited property – especially in cases of co-ownership with other people or real estate located in Poland, when the heir lives abroad. Polish law provides the possibility of selling the entire inheritance or an inheritance share even before the estate is formally divided (Articles 1051 and following of the Civil Code).

The sale of inheritance is concluded in the form of a notarial deed and allows the heir to quickly convert their inheritance share into cash. The buyer may be another heir or a third party.

My role as an attorney

I assist clients throughout the entire process of selling an inheritance or inheritance share:

b. I prepare and support negotiations and draft the agreement,
c. I represent the client before the notary – even if they live abroad,
d. I ensure the legal safety of the transaction and full compliance with the law,
e. I oversee the transfer of funds – ensuring they are sent directly to the client’s bank account.

Thanks to this process, the client gains quick access to cash and avoids the need to engage in complicated inheritance proceedings or co-ownership in Poland. For clients living abroad, the entire procedure can be completed remotely, without the need to leave their country of residence.
